Preamble

The current conditions of the online direct-to-air sales site are between, on the one hand, the S.P.R.L. under Belgian law Cegex, Pierre-Sol, based in Tournai, 438-A1 Lille Causeway below referred to as "Pierre -Sol" and/or "The Seller" and, on the other hand, people wishing to make a purchase via the Pierre-Sol website. http://www.pierreetsol.com or at the address listed as "The Buyer" and/or "User."

The shipment of parcels is considered to be from Belgium with exceptions, we deliver all over Europe and in the Dom-Tom. Other territories on request.

These conditions apply exclusively to non-trader individuals and legal and physical merchant persons. The Buyer who would like to buy on the Site, declares that he has full legal capacity. Anyone who is incapacitated under section 1123 and following the Civil Code cannot buy on the Site in any way. The consultation of the Site and the services it offers are then the responsibility of its legal representative. This legal representative is required to respect these stipulations. In any event, when transmitting personal data, the legal representative will have to compile the registration form himself or expressly authorize the person he represents to fill out the form, the stipulations relating to personal data as provided for in article 9 below, of course finding application.

The parties agree that their relationship will be governed exclusively by this contract, excluding any conditions previously available on the site.

If a condition were to fail, it would be considered to be governed by the practices in the remote sales sector of which the companies are based in Belgium.

Object

The simple act of ordering, orally or in writing, the payment of our invoices, implies by right the adherence of the customers to our terms of sale below.

These terms and conditions set out the applicable rules for the sale of S.P.R.L. PIERRE-SOL assets to its customers as part of a system of remote sales from the website www.pierreetsol.com . Both parties accept them unreservedly. 

The parties are contractually bound by the fact of putting an order and not its confirmation that appears on the screen and which is sent electronically to the address indicated and archived by Pierre-Sol.

The terms and conditions of sale constitute the entirety of the rights and obligations of the parties, no other conditions can be incorporated into them.

General

All documents, catalogues, notices and prospectuses, technical specifications or other specifications, are provided for information and do not engage the manufacturer or seller. The manufacturer and seller always reserve the ability to make any changes to the provisions, shapes, dimensions, weights and materials of his products, the engravings of which appear on these documents.

The technical specifications, plans, drawings and diagrams provided by the manufacturer and submitted by the seller as documentation or in support of proposals cannot be communicated by the buyer without prior agreement. They must be returned to the seller on request.

Commands

All orders must be the subject of a written order signed by the buyer's manager. It must accurately state the specification of the material with all the necessary details, mode and place of shipment, delivery time, accessibility of delivery, delivery condition,.... The absence of a written and signed order, incomplete or erroneous information could lead to errors in the execution, which could not be attributed to the seller.

The seller reserves whether or not to accept any order within 30 days of receipt. Confirmation of an order is the subject of an acknowledgement. If the seller refuses, the deposit is simply refunded to the buyer.

The receipt of the order, which confirms the seller's acceptance, stipulates the conditions of execution: product specification, price, conditions, delivery time, mode of transport, place of shipment, payment, customs charge,... It is recommended that the buyer carefully verify this acknowledgement and report any errors within 48 hours of receipt, as no challenge can be accepted at a later date.

An order accepted by the seller, may always be cancelled by the seller in the following cases and without compensation: stop manufacturing by the manufacturer for any cause or change in the regulations and prices imports, if any, change in the buyer's creditworthiness. In these cases, any payments that may be made are simply repaid. 

Any order is worth accepting these terms and conditions of sale, as well as prices and description of the products sold. 

Pierre-Sol is committed to honouring orders received on the website only within the limits of available product stocks. If the item is sold out, Pierre-Sol may have to deliver an item similar to the same or higher characteristics and at an equivalent price.

Delivery

The user has the choice of having it delivered either at home or at a third party's address.

Delivery times begin to run from the date of the receipt of the order and the payment by the Buyer of the expected down payment or amount. 

These deadlines are indicated by the Seller in view of its supply possibilities at the time under review and will be observed as far as possible. If an unpredictable delay occurs, the buyer would be informed immediately. In the event that the delay exceeds 3 months, the sums paid as a down payment on the order would be interest-rate-productive at rates of 1% per month. 

Delays cannot, under any circumstances, justify the cancellation of the order by the buyer, nor give rise to withholding or damages. Agreements made on this matter between the buyer and his client cannot be taken care of by the seller. 

The Seller is free, as of right, of any commitment relating to delivery times: - in case the terms of payment are not respected by the Buyer; In the event that the buyer does not provide the necessary information in a timely manner to execute the order; - in case of force majeure or events such as: strikes, lockouts, riots, war, international complications, requisition, fire, flood, interruption or transport delays, major accidents in the areamanufacturing tillage, rising energy prices,....  Delays in our own suppliers, whatever the cause, are a source of conventional force majeure in the seller's boss. It is strongly advised to order specific or custom-made materials as soon as possible to ensure a sufficient time range between the reception and the start of the work site. 

Any complaints about delivery times will have to be made by mail to the seller's address above. In the event of complete non-compliance with the delivered property, the seller agrees to remedy it or to reimburse the customer. 

Any delivery problems (missing or damaged product) must be reported to us within 48 hours to the telephone numbers listed above, by email and by recommended. Confirmation of receipt of the recommendation is proof that the claim has been received. The corresponding returned product must then reach us within 14 days of receipt requesting the exchange or refund. 

A flat-rate contribution of 25 euros is required for the costs of processing and shipping your products, this remains due even in case of full or partial return of the order as well as the costs of transport incurred and the costs of monetic or Paypal. 

In case our carrier refuses to ship your goods, we will contact you to study together an alternative solution. If Pierre-Sol is responsible for the inability to ship your products, we will make your full refund. We do everything we can to inform you of the delivery time ranges, once notified of your delivery, we require you in accordance with our general terms of sale to make you available on the day set to receive. In case of absence at the specified time range or on the specified day, a second attempt at delivery you will be charged a lump sum of 250 euros HT. 

After delivery, the ordered products are presumed to comply with the request without proof to the contrary being provided. The buyer is advised to receive the specific or custom-made goods at the depot before delivery. 

The seller is not responsible for any damage to sidewalks, pipes or other property belonging to others during the delivery of the goods, in cases where this delivery is not made on public roads. The buyer is liable for the damage caused to the seller's or carrier's equipment as a result of deliveries on unsuitable land. 

Responsibilities for damage during transport 

The risks of loss or deterioration of the material, as well as any risks related to its existence or use, are transferred to the buyer at the time of delivery which is deemed to be carried out in the seller's deposits. The material therefore travels at the risk of the recipient regardless of the mode of transport, whether the port is at the expense of the seller or that of the buyer. 

The buyer must ensure that the delivery and the condition of the parcels presented to him by the carrier are compliant before taking delivery and discharge. He will have to exercise any recourse, claim or reservations, in case of missing or damage, by letter recommended to the carrier within 48 hours of the arrival of the goods and copy of this letter must be addressed to the Seller. 

On delivery, you need to double-check the condition of thes delivered goods, including opening the or Package. We specify that the word "subject to unpacking" has no value. We advise you to carry out this check even if thee delivery man says he is in a hurry or if the outside of the carton appears to be in good condition.

WARNING: Without a specific reservation on your part on the carrier's voucher, NO exchange/refund support will be possible for it will be impossible to claim the fault of the carrier since the goods are entrusted to it "in good condition". 

Characteristics of products sold 

Pierre-Sol lets you know all the essential characteristics of the products offered for sale. 

These product features appear in online sales pages. Photographs have no contractual value, they have only an indicative value. 

The seller is not responsible for vices or color differences of natural stones and this is what makes the unique appearance of natural stone. Stone, brick and concrete are materials subject to variation depending on the operating or manufacturing conditions. 

The Buyer admit broken, partially broken products, imperfections,... when delivering up to a maximum of 5% in the packaging sold (boxes, crates, pallets,...), these defects are inherent in the nature of the product and their transport, the problematic elements can be used to make the cuts and the details of the installation.

Price 

After checking in the purchase order, it is clearly sent the price you have to pay and the postage. 

Prices are shown in euros () HT or TTC. The VAT rate, shown on the purchase order, is the one applicable on the day of the order for the country of delivery, if any, the buyer recognizes that the VAT to apply will be that of the day of delivery and the conditions of delivery. 

Delivery costs are calculated on a case-by-case basis and depend on multiple factors, such as distance between delivery and production or storage locations, quantities to be delivered, the nature of the mode of transport, accessibdelivery age, date and time of delivery, unloading time,... 

In the event of a promotional offer, promotions are made for a fixed period of time, so you should pay attention to the validity limit of the offer over time. 

Prices are freely determined by Pierre-Sol and can vary at any time. 

Order confirmation 

Any order placed at Pierre-Sol will be confirmed by e-mail no later than the day of the billing. 

This order confirmation will be the starting point for the parties' obligations. On this confirmation will be the mention of the property ordered, its price, its conditions of good completion,... 

The order confirmations will be archived on the Pierre-Sol server and will be considered to be worth proof of the nature of the agreement and its date. 

Withdrawal period 

Defective or non-compliant products will be exchanged or refunded as soon as possible. 

The products are presumed to be delivered in good condition, if one of your products is defective or non-compliant, Pierre-Sol undertakes to exchange it or refund it to you, provided the product is in its original packaging, without damage or breakage and the reasons for the return self indicated on the document to be attached to the package. Processing and payment costs are still due even if the package is returned completely. 

Given the nature of concrete, ceramic and custom products, they are neither repossessed, exchanged nor refundable.

Given the nature of the weightproducts and their weight:

• The standard delivery provided by the company is the removal by the customer in its stocks and deposits.
• The customer recognizes that each order is unique and made or made according to the specifications, needs and constraints of the customer. The order is like a distinctly personalized purchase.
• Our sales include, if any, the following services: preparation, de-palettisre-palletization, packaging, packaging and secure loading of the goods. This service service takes place on the day the contract is concluded, immediate execution of the service, before the end of the retraction period, and as such the client acknowledges expressly waiving his right of retraction.

TIP: To make your life easier when you return a product, Pierre-Sol offers you to pay back directly by wire transfer to your bank account. To benefit from this convenient, safe and fast service, all you need to do is provide your IBAN account number on the mailing slip that accompanies the returned product items and we will make the transfer as soon as possible.

All returns must be made within 14 days by returning the products to the address indicated by Pierre-Sol. 

Damaged, broken, soiled or already used items cannot be returned. 

In the event of abusive returns, Pierre-Sol reserves the right to refuse a subsequent order. 

Guaranteed items will only be taken back with your invoice. If the product cannot be replaced you will receive a bank cheque of the value of your purchase price.

For any refunds of less than 5 euros, Pierre-Sol will only pay the sums due to the buyer's Paypal account or turn the refund into a 1-year voucher.. 

Down payment and order balance 

Reservations for goods and/or orders are required to be paid by the Buyer with a down payment of at least 30% for standard products and 50% for custom products or individuals. The down payment is counted on the total value of the order and includes transportation. The percentage of the down payment may be higher in the case of a very specific order, special purchasing conditions, of the buyer's nature,... 

The Buyer must pay his order at least seven daysbear before the scheduled delivery date. This delay can be adapted according to the specifics of the transport. 

The delay in the payment of the balance of the order will automatically result in an interest of 1% per month started late with a minimum of 25 euros per month started late. The total amount of this interest will have to be paid before delivery. 

In the event of a delay in the payment of the balance of the order, a storage fee for pallets or order units will be recorded up to 25 euros per month started by Palette and/or storage unit beyond the 1st month after the expected delivery date. 

Except in the case of an express agreement between the Seller and the Buyer and after payment by the Buyer of interest and storage fees due each month, the Seller reserves the right to resell to third-party the goods ordered and not sold by the Buyer within four months of the expected payment of the balance of the order and to keep the deposit paid. 

Cancellation of order before delivery, non-receiving of goods and resumption of goods

Order cancellations remain possible with full refund excluding possible fees as long as the merchandise is not in progress de Preparation manufacturing or reserved.

Cancellations of custom merchandise manufacturing prevent the cancellation of the order without the withholding of a penalty of 100% of the value of the product. Transportation is refunded in deduction of a package of 15 TTC for administrative expenses.

Cancellations of orders for reserved or in preparation are refunded in deduction of 10% compensation for the non-tax value of the goods, storage costs, money transactions or Paypal and a package of 15 TTC for administrative costs.

Cancellations before preparation, manufacture or reservation are refunded in deduction of monetic or Paypal transactions and a package of 15 euros TTC for administrative costs.

Non-receipt or refusal of goods from the carrier - post - relay point -.... and the return of this goods to our offices results in the reimbursement of standard merchandise (excluding custom manufacturing) in deduction of outbound transport costs, return transportation costs, money or paypal transactions and a 15-euro package. TTC for administrative costs. This refund is activated as soon as the goods are received in good condition at the address indicated in advance by us.

Excess returns and repossessions of standard merchandise (excluding custom manufacturing) are refunded with a minimum deduction of 30% of the value of the goods unless there is a special agreement, monetic or Paypal transactions and a €15 TTC for administrative costs. This refund is activated as soon as it is received in good condition and in the original packaging of the goods at the address indicated in advance by us.

These conditions are subject to Belgian law. In the event of a dispute, Belgian law applies and only the courts of the judicial district of Tournai have jurisdiction. 

These terms of sale take precedence over the terms of the customer's purchase.

C. Order online, fax, or in writing with the 30% down payment and delivery price. 

D. Online confirmation of order and delivery date. 

E. Sends invoice indicating the date of the balance to be paid. 

F. Receiving the balance of the invoice on our accounts or receiving a cheque certified by the bank. 

G. Start of the delivery procedure with the carrier 

H. Delivery in the presence of the customer at the places and dates agreed in advance with the carrier 

I. Checking and Receiving The Goods. 

The reservation of the products requested by the customer will only be made when the order confirmation is sent and after receiving the deposit and the delivery price on our account. The announced short deadlines also from these payments. 

Payment terms

PierreetSol.com is committed to obtaining competitive prices for all the products presented. This requires specific trade policies with our suppliers, including the payment of purchased products in large cash.
